Congress St., Courtroom 2, York, SC, to the highest bidder, for cash in hand, all the right, title and interest in the following described property: All that certain piece, parcel or lot of land lying, situate and being in the Township of Ebenez er Township, County of York, State of South Carolina and being a certain condominium unit designated as UNIT G, 104, PHASE II, EAGLES LANDING HORIZONTAL PROPERTY RE GIME, INC., and being a part of Eagles Landing Horizontal Property Regime, established pur suant to Title 27, Chapter 31, Code of Laws of South Carolina, 1976, as amended, by Master Deed dated May 9, 1996 and filed for recorded on May 13, 1986 in the Office of the Clerk of Court for York County, South Carolina in Deed Book 883, Page 1 and First Amendment to Master Deed of the Eagles Landing Horizontal Property Regime, Inc. dated July 29, 1986 and recorded July 31, 1986 in Deed Book 897, Page 244 in the Office of the Clerk of Court for York County, South Carolina; together with an undivided interest of 1.25 per cent in the common elements of Eagles Landing Horizontal Property Regime, Inc. as defined and descri bed in the Master Deed above reference. DERIVATION: This being the property conveyed unto Tyrrell D. Baccus by deed of Gordon H. Timmons, dated June 30, 1998 and recorded in the Office of the Clerk of Court for York County, South Carolina in Record Book 2302, Page 89. Address: Eagles Place, Unit G-104, Rock Hill, SC 29730 Tax Map No.: 632-13-01-007 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master in Equity, at the conclusion of the bidding, five percent (5%) of the bid, in cash or its equivalent as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to the Plaintiff's debt in the case of noncompliance. Should the last and highest bidder fail or refuse to make the required deposit at the time of bid or fail to comply with the other terms of the bid within twenty (20) days, the Master in Equity may resell the property on the same terms and conditions on a subsequent sales day at the risk of said highest bidder. Interest shall run from the date of sale to the date of compliance with the bid. The lien being foreclosed is not a first lien on the property. The property is to be sold subject to taxes due thereon, and any other restrictions and easements of public record. A deficiency judgment is not sought in this case; therefore the bidding shall conclude on the sale day. The purchaser at sale is to pay for all documentary stamps and recording fees on the deed.
