THIRD AMENDED NOTICE OF SALE BY VIRTUE of the Order heretofore granted in the case of VFC Partners 31 LLC against Vision & Beyond Christian Ministry a/k/a Vision and Beyond Christian Ministry; Rev. Leroy McCrea a/k/a Leroy McCrea; Freddie Daniel; George McNeil; Jacqueline G. TMS#: 635-04-01-089 Parcel 2 TRACT A ALL that certain piece, parcel or tract of land lying and being situated in the County of York, State of South Carolina, and being shown and designated as Tract A containing 4.99 acres, more or less, on a Property Surveyed for Vision & Beyond Christian Ministry prepared by Fisher-Sherer, Inc. dated September 20, 2006, and recorded in the Office of the Clerk of Court for York County in Plat Book D184 at Page 3, and being more particularly described according to said plat as follows: BEGINNING at a one inch iron at the edge of S.C. Highway 901 (Mt. Holly Road) and running thence N. 32-52-34 E. 273.70 feet to an old iron; thence N. 32-41-47 E. 271.90 feet to an old iron at the edge of Northway Drive; thence with Northway Drive S. 14-05-02 E. 845.20 feet to a new iron at the intersection of Northway Drive and Caldwell Street; thence with Caldwell Street S. 89-43-59 W. 204.50 feet to an old iron; thence N. 14-07-34 W. 152.27 feet to an old iron; thence S. 75-25-39 W. 199.89 feet to an old iron at the edge of S.C. Subject to a 33 foot AT&T right-of-way across Tracts A and B as shown on the above referenced plat. BEING the same property conveyed to Vision and Beyond Christian Ministry by deed of Mary Lee B. Maynard, f/k/a Mary Lee Edwards, f/k/a Mary Lee B. Gryder, dated February 5, 2007, and recorded February 7, 2007, in the Office of the Clerk of Court for York County, South Carolina in Book 8809 at Page 99. TMS#: 602-07-01-045 (Tract A) and 602-07-01-046 (Tract B) ALSO With respect to the above-referenced property situated in the County of York, State of South Carolina, all of the following: All Property that Debtor owns or has sufficient rights in which to transfer an interest, now or in the future, wherever the Property is or will be located, and all proceeds and products of the Property. "Property" includes parts, accessories, repairs, replacements, improvements, and accessions to the Property; any original evidence of title or ownership; and all obligations that support the payment or performance of the Property. "Proceeds" includes anything acquired upon the sale, lease, license, exchange, or other disposition of the Property; any rights and claims arising from the Property; and any collections and distributions on account of the Property. TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Court, at the conclusion of the bidding, five (5%) percent of the bid, in cash or its equivalent, as evidence of good faith, same to be applied to the purchase price only in case of compliance with the bid, but to be forfeited and applied first to costs and then to Plaintiff's debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at the time of the bid or to comply with the other terms of the bid within thirty (30) days, then the Master-in-Equity or his designee may resell the property on the same terms and conditions on some subsequent date to be determined by the Court, at the risk of the said highest bidder. As the right to seek a deficiency judgment has been demanded, the bidding will remain open for thirty (30) days after the sale, unless waived by the Plaintiff, in writing, prior to the sale.
