Shady a/k/a James Anthony Shady, including their heirs, personal representatives, successors and assigns, and all other persons entitled to claim through them; and for all other unknown persons with any right, title, or interest in and to the real estate that is the subject of this foreclosure action, was filed in the Office of the Clerk of Court for York County on the 3rd day of January, 2019. YOU WILL FURTHER TAKE NOTICE that unless the said Defendants, or someone in their behalf or in behalf of any of them, shall within thirty (30) days after service of notice of this order upon them by publication, exclusive of the day of such service, procure to be appointed for them, or any of them, a Guardian Ad Litem to represent them or any of them for the purposes of this action, the Plaintiff will apply for an order making the appointment of said Guardian Ad Litem Nisi absolute. AMENDED LIS PENDENS NOTICE IS HEREBY GIVEN that an action has been commenced by the Plaintiff above named against the Defendant(s) above named for the foreclosure of a certain mortgage given by James Shady to Mortgage Electronic Registration Systems, Inc., as nominee for American Security Mortgage Corporation, dated October 23, 2008, recorded October 30, 2008, in the office of the Clerk of Court/Register of Deeds for York County, in Book 10386, at Page 35; thereafter, said Mortgage was assigned to Chase Home Finance LLC by assignment instrument dated September 10, 2010 and recorded September 15, 2010 in Book 11599 at Page 165. Thereafter, by virtue of a corporate merger, Chase Home Finance LLC merged into JPMorgan Chase Bank, National Association, with JPMorgan Chase Bank, National Association being the surviving entity; thereafter, assigned to JPMorgan Chase Bank, National Association by assignment instrument dated October 11, 2012 and recorded October 26, 2012 in Book 12972 at Page 292. However, this assignment was invalid with Mortgage Electronic Registration Systems, Inc. having already previously conveyed its interest. The Note and Mortgage were subsequently modified by a Loan Modification Agreement dated September 16, 2011. The description of the premises is as follows: All that certain piece, parcel, or lot of land lying, being, and situate in the State of South Carolina, County of York, designated as Lot 2 of Manning Oaks Subdivision, as shown on a plat of property recorded in Plat Book C-20 at Page 10, in the Office of the Clerk of Court for York County, South Carolina, which plat is hereby incorporated herein as part of this description and made a part hereof for a more accurate depiction of metes, bounds, courses, and distances. This being the same undivided one-half interest said property conveyed to James Shady by Deed of Casey C. Shady dated October 26, 2004 and recorded October 27, 2004 in Book 6646 at Page 257. Thereafter, Casey C. Shady conveyed her interest in the subject property to James Shady by Deed dated July 1, 2005 and recorded July 13, 2005 in Book 7236 at Page 4 in the ROD Office for York County.
